An Emergency Resolution of the City of Bonita Springs Declaring a State of Local Emergency Resulting from Hurricane Ian

The City of Bonita Springs, in following with Lee County, has declared a State of Emergency. A State of Local Emergency helps municipalities and counties prepare for and respond to situations such as hurricanes. A SOLE helps with governmental procurement processes, helps the community receive funds for recovery, and enables the ability of government to make decisions in response to the emergency that can be subsequently ratified.

CITY OF BONITA SPRINGS RESOLUTION NO. 22 - 59 HURRICANE IAN

 AN EMERGENCY RESOLUTION OF THE CITY OF BONITA SPRINGS DECLARING A STATE OF LOCAL EMERGENCY RESULTING FROM HURRICANE IAN; AND PROVIDING AN EFFECTIVE DATE.

WHEREAS, Governor Ron Desantis signed Executive Orders 2022-218 and 2022-219, in response to the anticipated landfall of Hurricane Ian and has declared a state of emergency, pursuant to Chapter 252, Florida Statutes; and,

WHEREAS, forecasting specific to Lee County indicates a strong likelihood of significant impact on this area; and

WHEREAS, Hurricane Ian has the potential for causing extensive flooding and potential wind and water damage to public utilities, public buildings, public communication systems, public streets and roads, public drainage systems, commercial and residential buildings and areas; and

WHEREAS, Chapter 252, Florida Statutes, provides authority for a political subdivision such as the City of Bonita Springs to declare a State of Local Emergency and to waive the procedures and formalities otherwise required of local governments by law pertaining to:

 

  1. Performance of public work and taking whatever action is necessary to ensure the health, safety, and welfare of the community;

     

  2. Entering into contracts;

     

  3. Incurring obligations;

     

  4. Employment of permanent and temporary workers;

     

  5. Utilization of volunteer workers;

     

  6. Rental of equipment;

     

  7. Acquisition and distribution, with or without compensation, of supplies, materials and facilities;

     

  8. Appropriation and expenditure of public funds.

NOW, THEREFORE, BE IT RESOLVED by the Mayor on behalf of the City Council of the City of Bonita Springs, Lee County, Florida;

Section 1. Hurricane Ian poses a serious threat to the lives and property of residents of the City of Bonita Springs and hereby declares a State of Local Emergency, effective September 26, 2022 for all territory within the legal boundaries of the City of Bonita Springs.

Section 2.      This resolution is an emergency measure necessary for the protection of the public safety, due to the proximity of Hurricane Ian.

Section 3.       Pursuant to Chapter 14 of the Bonita Springs Code, the Mayor is authorized to declare a local state of emergency.

Section 4. The City Manager is hereby empowered with plenary authority on behalf of the City Council to take all actions necessary for protection of persons and property authorized by law.

Section 5.       Effective Date

This resolution shall take effect immediately upon adoption. Consistent with Florida Statutes §252.38(3), the duration of this state of emergency declared locally is limited to 7 days and may be extended, as necessary by resolution, in 7-day increments.
